Shelley Wright / Wednesday, April 29, 2026 / Categories: News & Events Credible Service Maximum Limitation At the recent pension seminar, a question was asked about how earned service credit applies to Tier One members who entered service with the CFD at an early age and are exceeding the 75% final salary limitation. Under the Illinois Pension Code (40 ILCS 5/6-128), a member who completes 23 years of service before age 53 earns an additional 1% of service credit for each year of service beyond 23, up to age 53. This may result in up to 3% of service credit during that time, which may lead to an estimate exceeding 75%. Please be aware, another provision of the Code (40 ILCS 5/6-144) limits the maximum annuity to 75% of the member’s highest final average salary. While the Fund’s pension administration system continues to calculate the benefit as earned under Section 6-128, the 75% limitation is applied at the time of retirement.
